Lawsuits announced against NYC over deadly 2025 Harlem Legionnaires' outbreak

A group of lawyers, including civil rights attorney Ben Crump, alongside Rev. Al Sharpton are announcing lawsuits on behalf of the 2025 Central Harlem Legionnaires’ outbreak victims and their families.
In July 2025, New York City health officials identified an outbreak of Legionnaires’ disease in Central Harlem. Officials ultimately confirmed 118 cases and seven deaths, and traced the bacteria to cooling towers in the neighborhood, including those at Harlem Hospital and the New York City Public Health Lab at 40 W. 137th St. 
“We are not going to allow [the victims] to be forgotten,” Sharpton said. “It happened. It needs to be dealt with. Those that were negligent or in any way guilty need to be able to be called into accountability.”
According to the lawsuits, the defendants failed to properly test, treat, and maintain the cooling towers, failed to comply with state and city cooling tower regulations, and failed to warn the public of the danger. The suits seek damages for serious and permanent personal injury, emotional distress, economic loss, and wrongful death claims.
The lawsuits are against the City of New York, New York City Health and Hospital system, and the contractors responsible for maintaining the cooling towers.
“We want to make sure the right people are held accountable to these beautiful citizens of Harlem. It matters,” Crump said during Thursday’s press conference.
NBC New York reached out to New York City and NYC Health + Hospitals for comment.
“Protecting public health and safety is at the center of the City’s response. We will carefully review these cases,” a city spokesperson said.
This lawsuit comes at the same time that the Upper East Side is still dealing with the newest cluster of Legionnaires’ which has sickened more than 50 people and killed seven — matching the Harlem death toll last summer.
“I’m reading about people in other areas that are receiving a certain kind of attention and Harlem is being ignored,” Sharpton said.
Because this is the second year in a row New York city is dealing with a deadly legionnaires’ outbreak, Gov. Kathy Hochul signed new legislation Wednesday to improve inspections on cooling towers in New York City.
In a statement, Hochul said in part: “Recent outbreaks of legionnaires’ disease underscore the urgency of certification requirements, and we look forward to working with the city to ensure new yorkers are protected against these public health threats.”
