The captain of a motorboat that capsized in New York Harbor and killed a mom and her baby was not licensed to operate the vessel – and was actually hired as a limo driver, new court documents reveal.
Manuel Hernandez, 46, was allegedly running an illegal charter operation when he overloaded the 21-foot boat with 13 passengers on Saturday night, and lacked required safety standards that included child or infant-sized life jackets, federal prosecutors said.
Sara Sanchez, 27, and her 5-month-old daughter, Antonella Garcia, drowned shortly before 10:30 p.m. when the boat was struck by a swell while making a U-turn near Liberty Island, while panicked survivors clung to the overturned vessel until help arrived.

How do we know Sara Sanchez, 27, and her 5-month-old daughter, Antonella Garcia would NOT have died if Hernandez had the proper licenses/training?
I get it that the chances would have probably been less. I am just playing devils advocate here.

They didn’t check for any valid Boat or Captain’s Licenses?
Sounds like wharf owner is in deep legal trouble too ...

So the illegal truck driving thing has expanded to water operations.
I hope the family of two poor drowning victims sue the boat owner into complete and abject poverty.
And as a side note, just when I start to hate “ambulance chasers” a story like this one comes along.

A 21ft boat is a dingy in NY harbor. Not even close to seaworthy in those waters.
and I doubt 21 foot anything was rated for 13 people. More like 6-8.

That’s right. Newt survived a whole month without any training.
Though I have to confess. I drove a 45 foot long gunboat in Vietnam with the only training being what the experience coxswain showed me. No license. Never dumped any passengers out though. Not even after a typhoon blew through leaving 8 foot swells.

Children on boats must wear life jackets at all times. The mother, may still have died because they can choose not to wear one but the baby would likely be alive.

From the article: Prosecutors said Hernandez owns his own motorboat, which was in disrepair, so he borrowed a friend’s for the tour...
So... the friend is an accomplice.
