EAT upholds seven-figure penalty for bypassing collective bargaining

Дата публикации: 10-08-2026 06:00:04

The Employment Appeal Tribunal (EAT) has upheld a near-£5 million penalty against the successor employers of Virgin Trains East Coast (VTEC) for making unlawful direct pay offers to its workforce. The case, London Northeast Railway Ltd & Another v Nimu Jiwanji and Others, serves as a stark reminder that businesses cannot unilaterally decide to bypass collective bargaining processes without facing severe financial consequences.
