Domestic biotech company AbTis has won a U.S. patent dispute with a Japanese company.

AbTis announced on August 14 that it won the Inter Partes Review (IPR) filed by Japan’s Ajinomoto at the U.S. Patent Trial and Appeal Board (PTAB). This review began when Ajinomoto questioned the validity of the U.S. patent regarding AbTis’s core ADC platform technology, ‘AbClick’. The U.S. Patent Trial and Appeal Board entirely dismissed Ajinomoto’s invalidation claims through a final written decision and decided to maintain AbTis’s patent.

Ajinomoto mobilized various legal grounds to invalidate AbTis’s patent during this review process. It launched a full-scale offensive, claiming violations of the written description requirement, enablement requirement, and definiteness under Article 112 of the U.S. Patent Act, as well as a lack of novelty under Article 102 and a lack of non-obviousness under Article 103.

However, the U.S. Patent Trial and Appeal Board did not accept any of the claims raised by Ajinomoto. By dismissing not only the substantive requirements of the patent but also all incidental claims raised regarding procedures and evidence, it clearly recognized the originality and scope of rights of AbTis’s technology.

AbClick, which became the core of the victory, is a site-specific ADC platform technology that selectively conjugates drugs to a specific lysine (Lys248) in the antibody Fc region. This technology can realize a uniform drug-to-antibody ratio (DAR), playing an essential role in producing new ADC drugs of consistent quality.

As the ADC field rapidly grows in the global pharmaceutical market recently, the value of conjugation platforms that realize new drug candidates and related original patents is increasingly rising. With this victory, AbTis has secured a strong legal foundation to protect the AbClick platform in the United States, the world’s largest pharmaceutical market.

AbTis expects that discussions on global technology transfer and new partnerships will become more active in the wake of this decision. Currently, the company is developing its own ADC pipeline based on AbClick while simultaneously pursuing technology commercialization with domestic and foreign pharmaceutical and biotech companies.

Choi Hyung-seok, CEO of AbTis, emphasized, “With this decision, we have confirmed the validity of the core patent that protects the AbClick platform in the United States,” and “Based on differentiated technology and patent competitiveness, we will expand global partnerships and continue to develop new ADC drugs.”
