Now their 150-acre farm in Kewaunee County, home to 30-some cows plus additional steers, is surrounded by dairy farms that house many thousands of animals each, Utesch lamented one rainy day this spring as he walked across the sodden grass toward his herd.

Today, Kewaunee County has among the country’s highest proportion of factory-farm dairy operations, often known as concentrated animal feeding operations, or CAFOs.

These dairies have expanded quickly in recent years, boosted in part by the presence of biodigesters, which collect gases (primarily methane) from manure to produce biogas.

Biodigester operators can sell the biogas to fuel companies and claim lucrative renewable energy credits through state and federal programs, passing some of the revenue on to the dairy.

Supporters applaud the technology, used widely in dairy farms and hog CAFOs, as a way to reduce manure stored in lagoons and generate gas that can replace fossil fuels.

Some farms, like organic Straus Family Creamery in Northern California, have long used the biogas from manure to generate electricity to power their own operations and sometimes send electricity to the grid for revenue.

But when biogas is sold into larger gas markets, critics cite many issues.

Environmentalists say that biodigester incentives encourage dairies to add more cows to produce more poop, which increases air and water pollution.

Small farmers note that biodigesters are most likely to benefit the largest operators, meaning they increase the competitive edge that these players already have. And academics say that the carbon reduction benefits of biodigesters are questionable.

Indeed, Utesch thinks it is a “fallacy” that biodigesters are “green” or that biogas is clean.

“Digesters have been touted as a cure for the many problems of the CAFO industry, while in reality all they do is multiply the problems,” he said. “What digesters provide is a way for CAFOs to milk the taxpayers as much as they milk the cows.”

Despite the well-documented and frequently voiced concerns, biodigesters have enjoyed financial support from state and federal governments as well as private investors. But after a boom in the early 2020s, the financial outlook for biodigesters now appears dimmer, at least on some fronts.

The once-lucrative payments for providing fuel companies with “renewable” gas have diminished in value, and environmental groups are suing over changes to that program meant to bolster that value.

The Internal Revenue Service (IRS) is debating terms of its federal tax credit for clean fuels—another revenue source for biodigesters. And the U.S. Department of Agriculture (USDA) has halted grants and loan guarantees for biogas production.

In other words, biodigesters are at an inflection point. But industry boosters remain bullish about the technology, and watchdog organizations warn that biodigesters may be well-poised to capitalize on spiking energy demand as well as global sustainability incentives.

How Biodigesters Work

Utesch’s cows graze and drop manure as they meander—on this spring morning they are doing just that, fanned out across the lush green and slightly muddy pasture.

Exposed to the air, the cow pies decompose through an aerobic process that does not release much methane. (Cows release much more methane when they burp.)

The manure from concentrated dairies, by contrast, is collected into giant pits often referred to as “lagoons,” exuding methane from the anaerobic decomposition that happens when little oxygen is present.

Many dairies periodically empty the pits by spraying manure onto fields of crops. Manure can instead be fed into biodigesters—which often look like large, inflated domes—that capture the methane-heavy biogas resulting from the breakdown of manure.

Many farms with biodigesters operate on a hub-and-spoke model, meaning the collected biogas is pumped through pipelines or transported by truck to a centralized refinery.

At the refinery, it is processed to remove water, carbon dioxide, and other elements, transforming it into Renewable Natural Gas (RNG). This fuel—chemically almost identical to fossil-fuel natural gas—can be turned into compressed natural gas (CNG) or liquefied natural gas (LNG) and used to power vehicles or injected directly into a utility’s natural gas pipeline.

Refining isn’t necessary when biogas is burned to generate electricity, powering a farm or sending electricity back to the grid.

Waste left over from the digesting process—a slurry known as digestate—can be spread on fields as fertilizer, or dried and used as bedding for animals.

In theory, it all sounds like a way to make farms more sustainable. But some fear that federal and state biogas incentives encourage dairies to grow to unsustainable levels, producing more waste than the land can handle, even with some of it diverted to digestion.

A 2024 study by Friends of the Earth found that Wisconsin dairies with digesters grew at 52 times the rate of those without. A California study covering 2016 to 2025 found that dairies had added an average of 860 cows three years after installing a biodigester, and net methane emissions increased as a result.

But Patrick Serfass, executive director of the American Biogas Council, noted that dairies have been expanding for decades, and biogas production helps reduce the methane emissions and handle the manure that inevitably results.

“There’s so much methane being put into the atmosphere from open-manure lagoons, [and] there is a very easy and attainable benefit that can be made from capturing all of that methane” and transforming it into renewable natural gas, used primarily to power vehicles, Serfass said.

He also points out that biodigesters can provide crucial revenue or energy bill savings for small farms as they burn the biogas to create their own electricity, or tap credits.

But the numbers show that digesters are far more likely to be on large farms (in fact, the biogas council’s data shows that only 21 farms with fewer than 500 cows have biodigesters).

The Impact of Biodigesters on Kewaunee County

As a teen in the 1970s, Utesch milked cows on his aunt’s dairy farm in central Wisconsin. With only around 50 animals, he “knew the personality of each cow, which ones kicked, which ones I could pet,” he said.

Nowadays, most dairy cows spend most of their time in tight stalls in sprawling buildings. The picturesque wooden barns that still decorate the rolling hills of Kewaunee County are largely empty and crumbling, with roadside signs advertising barn demolition.

Friends of the Earth noted in its 2024 study that over the past 30 years, the number of cows in Kewaunee County has increased by 88 percent, even as the number of dairies has decreased by 82 percent.

Pagel’s Ponderosa dairy was the first to get a biodigester in Kewaunee County, in 2009. Three more dairies installed biodigesters over the next three years, and then in 2020, Kinnard Farms, with over 9,000 cows, acquired a digester, according to the Friends of the Earth study.

All Kewaunee residents live within 10 miles of a biodigester, according to the study, and each of the operations has been cited at least once for improper application of waste on land.

Federal data shows Wisconsin having the most biodigesters, at 48, of any state after California. Seven of them are in Kewaunee—one of Wisconsin’s smallest counties. That day in May, Utesch drove his pickup through the rolling hills around his farm and pointed them out.

All Kewaunee residents live within 10 miles of a biodigester, according to the study, and each of the operations has been cited at least once for improper application of waste on land. Multiple studies have documented E. coli and other pollution in the county’s residential wells, likely caused by manure.

And while biodigester proponents often tout that the facilities replace smelly uncovered manure pits, Utesch and other critics lament that biodigester farms typically still have pits of waste—either manure waiting to be fed into the digester or the slurry remaining after the process. And they still smell.

Nationwide, people who live around digesters say their foul odor comes both from the uncovered manure and the exhaust from the biodigesters themselves, though the EPA notes that “what comes out of a digester after processing is much less odorous than the feedstocks that go into digesters.”

As Utesch toured the county, clouds of steamy white exhaust emanated from smokestacks or vents at the dairies.

State Support Is Less Certain

Many of the digesters in Kewaunee County make money through a California program meant to reduce the greenhouse gas emissions of transportation in the state. Other states, including Washington, Oregon, and Hawaii have similar programs, though California’s is the largest.

Under these state programs, fuel companies are required to reduce the carbon intensity of the fuel they sell in the state. They can do this by purchasing credits representing biogas that could potentially flow into the state.

A fuel company that does business in California, for example, can pay a Wisconsin biogas producer and receive credits representing biogas that could end up in California vehicles. To qualify for credits, the biogas must be sold to a company that provides fuel or has vehicle fleets in California or be injected into a gas pipeline that connects to California.

Under California’s Low Carbon Fuel Standard (LCFS) program, the credit value is based on “avoided methane” emissions—meaning the specific amount of methane that would have been released if a farm’s manure were to decompose in an open lagoon instead of being captured in a biodigester.

Environmental advocates argue that states can design programs to promote clean transportation without disproportionately boosting biodigesters.

The cost of a credit has decreased dramatically, however: In early 2020, a credit on California’s market was worth over $200. But by early 2025, the value of that credit hovered just over $50, according to the California Air Resources Board (CARB), which runs the program.

CARB implemented changes to the program last summer to increase the value of credits. These amendments also made biogas eligible for incentives related to industrial processes and hydrogen production, further increasing the revenue available to biodigesters.

Food and Water Watch and several other environmental groups sued over California’s plan, saying, “the LCFS is already causing perverse outcomes that undermine the integrity of the program, harm the climate and local environmental quality.” The lawsuit alleges the 2025 amendments “will exacerbate those problems.”

Environmental advocates argue that states can design programs to promote clean transportation without disproportionately boosting biodigesters.

In New Mexico, for example, legislators recently adopted a clean transportation fuel program that groups like Food and Water Watch have lauded for the safeguards it includes, which prevent credits from being awarded based on dubious avoided methane emissions.

Federal Funding Hurdles

The American Biogas Council says that there are nearly 500 biodigesters at dairies nationwide, with the volume of gas captured increasing steadily since 2020. The council would like to see biodigesters at the almost 3,000 dairies it has identified nationwide that have more than 500 cows.

It applauded the Trump administration’s creation of a new incentive, the Clean Fuel Production Credit, which could be especially lucrative for biodigesters because of how credits are calculated.

The federal government offers tax credits to biodigester operators based on two factors: the “avoided emissions” from methane that a farm’s manure would have caused without a biodigester, and the amount of diesel fuel their biogas could displace if used to power vehicles.

Combining these two calculations means that biodigester operators can actually claim their greenhouse gas footprint is less than zero—and get paid for those “negative emissions.”

The One Big Beautiful Bill (OBBB), backed by the Trump administration, barred Clean Fuel Production credits based on such negative emissions—except for biogas from manure.

The Treasury Department in February proposed rules to put the credit into practice. Now environmental groups are asking the government to remove the exception allowing biogas to claim negative emissions.

While the Trump administration created this new credit, the federal government has for years funded biodigesters through the U.S. Department of Agriculture’s Rural Energy for America Program, or REAP. An analysis by the organization Farm Forward found that in 2023, REAP provided $150 million to farm biogas projects.

REAP also offers loan guarantees, promising the government will cover the cost if a biodigester company or farmer takes out a loan to build a biodigester and can’t pay it back.

But the future of REAP funding for biodigesters is in doubt.

In January, the USDA halted federal loan guarantees for biodigesters for 90 days, because of the high rate at which these projects were defaulting on their loans and needing government bailouts.

On March 31, the USDA announced it was pausing the REAP program entirely, so that the government could adopt rules in keeping with Trump’s executive order barring subsidies for projects relying on “entities of foreign concern” like China in their supply chain.

In April, the USDA extended the moratorium on loan guarantees for biodigesters through the end of 2026, citing a loan delinquency rate of 28 percent. An analysis by The New Lede found that one Wisconsin company, BC Organics, was responsible for the vast majority of the federal loan guarantee defaults. BC Organics operates in Brown County, just west of Kewaunee County.

Though the federal government paused the loan guarantee program for financial reasons, environmental and community groups had their own motivation to praise the move.

In January 2026, a large coalition of environmental and community groups had filed a lengthy petition with the USDA asking it to stop federal support for biodigesters, saying the digesters eroded the economies and health of rural communities.

“We ask for no more grants or loan guarantees to digesters, ever,” said Kara Goad, senior associate attorney for Earthjustice, the environmental law firm representing the groups. “That would be the real victory.”

Emerging Markets for Biodigesters

Even as the future of some incentives is in doubt, biodigester critics fear the investors, fossil-fuel companies, and factory farms with stakes in biogas will keep finding new ways to keep biodigesters profitable.

The CAFOs that provide manure and space to the digesters are only one piece of the puzzle. Digesters are often owned by private-equity investors sometimes tied to fossil fuel companies.

For example, Brightmark RNG owns biodigesters in multiple states through a joint venture with Chevron, and a company called Freehold Energy RNG, which operates as several other LLCs, owns digesters in Michigan.

John Peck, a small-scale farmer based near Madison, Wisconsin, and executive director of the grassroots group Family Farm Defenders, said that while federal government support has given biodigesters “more legitimacy,” in the future “the momentum is going to come from the private sector.”

A prime example is Vanguard Renewables, a company developing biodigesters nationwide that run on both manure and municipal food waste. This boosts the volume of biogas produced, and the operator receives tipping fees (of the type paid to landfills) or other revenue as a result.

This can reduce the strain on landfills, but also raises the risk of spreading PFAS and other contamination—not to mention that it props up the biodigester business model.

“It was a really bad, poopy smell combined with weird chemical overtones—those odors were just horrendous.”

Kathy Morrison spent years fighting a biodigester that accepted food waste near her orchard in Michigan. After more than a decade of operation, that biodigester shut down last year because of a permitting issue.

Now another biodigester is proposed in her county, and she fears it too will accept food waste.

While food waste provides a new feedstock to farm biodigesters, emerging markets for selling biogas and receiving credits also support the technology.

The shipping giant Maersk and Vanguard Renewables, among others, have studied the potential of biogas as a sustainable maritime fuel.

Farm biogas is also cited as a way to generate “sustainable” electricity for data centers, which are often being proposed near the same farming communities—like Utesch’s—that are beleaguered by expanding CAFOs.

Treasury Department rules announced shortly before Trump took office made renewable natural gas (RNG), including from biodigesters, eligible for potentially lucrative tax credits for helping produce clean hydrogen. And private and foreign credit markets could provide a growing revenue source.

Such markets often operate on models similar to the state fuels programs, offering businesses a way to meet their sustainability goals or national targets by buying credits.

“There’s always going to be another market,” said Sarah D’Onofrio, a lecturer at the University of Tennessee-Knoxville who studied the boom-and-bust cycle of biodigesters for her doctoral thesis. “It’s a problem looking for a solution.”

An Alternative

Sustainable farming advocates say that the whole biogas “problem” could be avoided if farms used more environmentally friendly methods.

Utesch’s cows never eat the kind of grain mix that most factory farms rely on. Rather, they graze on rotating plots of pastureland, augmented in the winter with hay bales. They poop as they wander, adding fertilizer to the land that will decompose with minimal greenhouse gas emissions.

When cows aren’t free to graze, manure composting—through combining the solids with sawdust, for example—can be a low-emissions alternative to anaerobic decomposition, even at large-scale dairies. The compost can then be used as bedding for cows or sold as fertilizer.

California has offered incentives for this type of manure composting. Texas cattle operations have also turned to composting to deal with the state’s regulations on manure runoff.

“We shouldn’t be treating animals like widgets and putting them in factories to maximize corporate profits at the expense of communities and the environment.”

Serfass, of the American Biogas Council, said composting manure is an important option, but many large dairies don’t have enough space to compost all the manure they produce. And Tyler Lobdell, staff attorney at Food and Water Watch, said that itself is a problem.

“Factory farm gas production only exists because of our current reliance on destructive factory farms. At its base it’s really, really simple—we shouldn’t be treating animals like widgets and putting them in factories to maximize corporate profits at the expense of communities and the environment,” Lobdell said. “There should be no market for factory farm biogas. The only reason it exists at all is because of a problem we should fix.”

Utesch heartily agrees. And he hopes that the uncertainty around biogas incentives and increasing awareness of biodigesters’ drawbacks will ultimately curb their proliferation.

Surveying his herd that day in May, Utesch watched his massive bull defecate—and noted that the steaming pile of manure would naturally disappear within about two weeks. Dung beetles would help with the natural decomposition, he said, by bringing particles underground.

This is the way manure from the buffalo once fertilized the lush prairie grasses, Utesch mused. “It’s like nature had this all figured out.”
