On May 4, 2026, The Immigrant Legal Resource Center (ILRC) submitted a formal comment opposing proposed changes to the EOIR-33 change-of-address form, arguing that the revisions are procedurally improper and substantively harmful. The ILRC contends that the Department of Justice inappropriately implemented the changes under emergency procedures without justification or public input. Substantively, the organization warns that eliminating the “in care of” address option will undermine immigrants’ ability to reliably receive critical court communications—especially for vulnerable populations facing housing instability, language barriers, or trauma. The comment further argues that the changes disregard longstanding reliance on the form, will increase missed hearings and in absentia removal orders, and raise serious due process concerns by making it less likely that individuals receive proper notice in their immigration proceedings.
