The piece was set to be dismantled after it was deemed dangerous and unsalvageable after the wood structures deteriorated. In 2023, Miss filed a lawsuit after learning it was set to be destroyed claiming breech of contract against the Center for not protecting and maintaining the work properly according to their 1994 agreement. They settled for $900k and the piece has been removed.
