The estate of a man killed in a 2025 gym shooting has accused the property owner of failing to provide adequate security.

The estate of a man killed in a 2025 shooting at a West Las Vegas gym has filed a wrongful death lawsuit against the property owner.

Attorneys for Jennifer Ortiz, an heir and administrator of Edgar Quinonez’s estate, filed the lawsuit in District Court on Tuesday. It accuses Jermac, LLC of failing to provide or require adequate security at the Las Vegas Athletic Clubs located at 1725 N. Rainbow Blvd., near West Lake Mead Boulevard.

The lawsuit states that Jermac leases the property to Las Vegas Athletic Clubs.

Quinonez, 31, died of multiple gunshot wounds after 34-year-old Daniel Ortega fired 24 shots from an AR-style rifle inside the fitness facility on May 16, 2025. Three other people were wounded before Metropolitan Police Department officers fatally shot Ortega outside the gym.

“As a landowner that delegated operational control to its tenant, defendant Jermac retained a duty to ensure that reasonable security was provided, and its total failure to require or verify any security measures constitutes a breach of that duty,” the lawsuit states.

The attorneys for the estate and Jermac did not respond to a request for comment.

Metro officers responded at 1:39 p.m. after more than three dozen people, consisting of employees, patrons and neighboring businesses, reported gunfire at the gym, police and audio records showed.

One caller told dispatchers that she saw Ortega walk into the gym before he demanded that she and other employees leave. Ortega opened fire shortly thereafter, fatally wounding Quinonez, a manager who worked at the gym for about 15 years.

During a media briefing last year, assistant sheriff Jamie Prosser said a weapons malfunction prevented the incident from becoming a mass casualty event. Ortega had additional ammunition and magazines on him, police said.

The lawsuit argues that Jermac had a duty “to maintain the subject premises in a reasonably safe condition, to provide adequate security, and to protect persons on the property from foreseeable criminal acts of third parties.”

Attorneys for the estate said in the legal filing that the property was located in an area with a history of criminal activity and there had been numerous calls for law enforcement to respond to the property or surrounding area.

They noted that Jermac’s lease agreement with LVAC does not include requirements for security, whether that is personnel or surveillance technology.

The lawsuit also accuses Jermac of negligent hiring, training and supervision of employees, including in the reporting and discovery of suspicious activity.

The estate seeks damages in excess of $100,000.
