etired Chief Justice Mark Recktenwald joins producer/host Coralie Chun Matayoshi to discuss who can legitimately donate to political candidates, the Hawaii State Legislature’s novel attempt to keep dark money out of Hawaii politics through Act 11 (SB 2471), whether the state can prohibit corporations from spending money or contributing anything of value to influence elections or ballot measures, whether Act 11 applies to non-profits, unions, and Super PACS, and Act’s “failsafe” clause that would invalidate the entire law if Act 11 was found unconstitutional only as to foreign corporations (so that foreign corporations could not enjoy greater privileges than domestic corporations).
