A federal judge has officially consolidated a pair of class action lawsuits centering on a November 2025 Suno breach that’s said to have compromised “the sensitive data of 55 million users.”

The first of those cases set sail on July 24th, while the second, likewise filed in Massachusetts, kicked off on the 28th. Both named Cambridge-headquartered Suno as the sole defendant and in more words accused the AI platform of negligence and breach of implied contract in connection with the aforementioned late-2025 “security incident.”

Why the delay between this alleged breach and the lawsuits themselves? Per the first action, the alleged “victims were not informed of the Data Breach until July 20, 2026 when news outlets,” running with findings from breach-notification service Have I Been Pwned, “broke the news publicly.”

Not stopping there, the straightforward complaint described the filing party and others in the same position as “wholly unaware of the Data Breach for nine months until public news sources disclosed the breach.”

Meanwhile, the suits also framed the plaintiffs as grappling with an alleged post-breach spike in spam and phishing calls and emails. The second complaint further emphasized that the welcome email forwarded to the plaintiff upon signing up for Suno didn’t “display, summarize, or hyperlink any arbitration provision.”

And out of the gate, said second action’s counsel acknowledged the complaint’s being related to that which had been filed days beforehand.

Now, one consolidation motion later, the presiding judge has combined the cases and afforded the plaintiffs 30 days to submit a fresh action.

From there, Suno, which is currently looking to hire lead security engineers at all three of its offices, will have 45 days to respond.

In place as interim co-lead class counsel are Lynch Carpenter partner Gerald D. Wells III and Milberg’s Casondra Turner; the latter firm, which one year ago fired off a suit accusing Roblox of being “a haven for adult sexual predators and pedophiles,” bills itself as “a pioneer in federal class action litigation.”

With that, Suno is now staring down suits from the alleged breach victims, Universal Music, Sony Music, Round Hill and, in another class action, indie musicians. Put differently, even with Warner Music and BMG licensing deals in the books, the cash-flush AI music generator has plenty of courtroom confrontations on its plate.

Regarding possible operational obstacles, time will tell how the platform’s user and subscriber bases respond to policy changes including download limits – especially once competing gen AI offerings from Spotify, Klay Vision, and others yet are available.
