An Indiana man has been charged with manslaughter and operating under the influence days after a Hancock County crash that killed his 5-year-old son and injured his infant daughter.

Dion Campbell, 33, of Elkhart, Indiana, also faces charges of aggravated driving to endanger and endangering the welfare of a child, Maine State Police said in a news release Wednesday. Campbell was arrested Monday and taken to the Hancock County Jail, according to police.

After making his initial court appearance Wednesday afternoon, Campbell was released on $3,000 bail, his lawyer Hunter Tzovarras said. He did not enter a plea.

Police say a state trooper happened upon the one-car crash just before 11:30 p.m. June 25 near the intersection of Routes 9 and 193 near Beddington.

The preliminary investigation indicated that Campbell failed to stop at the intersection and then struck an embankment. Police said it also appears neither the 5-year-old boy nor the 10-month-old girl were properly restrained at the time of the crash.

The boy was sitting in the vehicle’s front seat, police said. Under Maine law, children under 12 are required to sit in the back seat “if possible.”

The boy was pronounced dead at the scene, despite lifesaving efforts by the state trooper and EMS personnel.

Campbell and the 10-month-old girl were taken to Northern Light Eastern Maine Medical Center with injuries that police said were not considered life-threatening.

Tzovarras said his client broke both legs and has been using a wheelchair since the crash. The 10-month-old has a broken leg and arm and is expected to make a full recovery, he added.

In a phone interview Wednesday, Tzovarras disputed the allegation that Campbell was under the influence. He said a field sobriety test wasn’t conducted at the scene because of Campbell’s injuries, but that Campbell later tested positive for THC, the main psychoactive component in cannabis, in a blood test.

“THC could stay in the blood for weeks, so it certainly isn’t an indicator that he was impaired at the time of driving,” Tzovarras said.
