Epic filed its response on Monday, and very briefly implied that Apple wasn't being serious in its filings. However, if the court ordered a settlement conference, Epic would participate.
The attitude has been present throughout the Apple lawsuit, but Epic seemingly rolled over at the first sign of a profitable partnership during its Google lawsuit. Epic says it will "entertain any direct approach from Apple with a serious settlement proposal that would introduce competition and benefit all developers."
This language and attitude were fully missing from the Google settlement in which Epic paid Google $800 million over six years to promote Fortnite on its platforms. It doesn't seem like this agreement helped anyone but Epic, nor does its continued battle with Apple.
The continued hypocrisy will continue until either some agreement is reached in the lower courts or the Supreme Court decides to side with Apple in October. Until then, Epic CEO Tim Sweeney will continue to claim he's fighting for the little guy.
