Former Montco official, daycare owner rejects plea deal in child sex abuse case

A former Skippack Township supervisor accused of sexually abusing a child over a period of years has rejected a plea agreement in Montgomery County, sending the case to trial.
Nicholas Fountain, who also worked in childcare, had agreed to a plea deal before changing his mind on Wednesday. Prosecutors said they are now done negotiating and preparing for trial.

The judge said the last 10 months have been lost and that the legal process will essentially begin again.
The proposed plea agreement could have made Fountain eligible for parole after 20 years, according to information revealed in court. The agreement would also have spared the victim from having to testify in court about abuse prosecutors say occurred over a period of years.
Fountain told the judge he understood he could face more time in prison if convicted on all charges.
Defense attorneys did not comment on Fountain’s decision to reject the plea agreement. They told the judge they plan to seek to suppress evidence, including what police say was a confession from Fountain admitting to sexually abusing the child.
Fountain has been held in the Montgomery County prison. He was initially facing charges in Maryland before Montgomery County officials filed charges several weeks later.
Fountain resigned as a Skippack Township supervisor last year after he was charged with 10 counts of involuntary deviate sexual intercourse and other crimes involving a child who had been in his care.
As the Montgomery County case currently stands, Fountain faces a mandatory minimum of 10 years for each of the 10 counts, according to information presented in court. Other charges could carry additional prison time.
Fountain was one of the operators of Magnolia Early Learning Center in Skippack. His LinkedIn profile also listed work as a kindergarten teacher at another local daycare.
The first criminal charges against Fountain came after investigators in Maryland conducted an undercover child sex abuse material sting. Investigators alleged Fountain was attempting to buy child sex abuse material from someone he believed was 14 years old.
According to the Montgomery County prosecutor, the Maryland investigation ultimately led authorities to the victim in Montgomery County.
