Maine delegation calls for expedited review of Biddeford ICE shooting

In a letter Tuesday, the state's 4 members of Congress outlined key elements that federal authorities should include in their investigation of a 26-year-old man's fatal shooting by a federal immigration officer.

Maine’s congressional delegation is asking for an expedited independent review of the fatal shooting involving federal immigration agents in Biddeford.

U.S. Sens. Susan Collins and Angus King, and Reps. Chellie Pingree and Jared Golden on Tuesday wrote to the U.S. Department of Homeland Security Office of Inspector General requesting the investigation.

Their request comes a day after Joan Sebastián Durán Guerrero, a 26-year-old man from Colombia, was shot and killed by an Immigration and Customs Enforcement agent.

The agency said it was conducting surveillance at the address of a person with an immigration removal order at the time, though federal officials have said that Guerrero was not the target of their warrant. Immigrants’ rights advocates said Guerrero was authorized to work in the U.S.

Collins had announced on Monday that the Boston office of the DHS inspector general would be handling the shooting investigation,and Tuesday’s letter lays out key aspects the lawmakers believe should be included in the probe.

They asked that the office construct a detailed timeline of the encounter, an evaluation of whether the tactics used follow DHS and ICE use-of-force policies, and provide clarification on the availability of audio, dashcam or body-worn camera footage of the incident.

The delegation is also asking the office to detail the extent to which DHS will collaborate with state or local agencies on their investigation.

“DHS OIG routinely reviews allegations involving DHS employees or contractors who, while acting under color of their official authority, are alleged to have deprived an individual of any constitutional right or liberty,” the DHS Office of Inspector General said in a written statement.

“These include allegations of use-of-force incidents resulting in death. However, to preserve our independence and protect the integrity of our work, we do not discuss specific investigative matters, and we do not confirm or deny the existence of an investigation.”

The agency previously announced in January it is undertaking an audit of ICE’s processes for investigating and addressing allegations of excessive use of force. Officials said Tuesday that project is ongoing.

The delegation, meanwhile, urged the agency to also prioritize the Biddeford investigation.

“Timely and factual answers will be critical to providing closure for the grieving community and ensuring that federal law enforcement operations are conducted safely, lawfully, and in a manner that respects public safety,” they wrote.
